To the extent Fobo Tyre Australia cannot lawfully disclaim any applicable implied or statutory rights relating to this Product, nothing in this warranty is to be interpreted as excluding, restricting or modifying any State or Federal legislation applicable to the supply of goods and services which cannot be excluded, restricted or modified. If you are a consumer, this Warranty applies in addition to the rights and remedies available to you under the Australian Consumer Law.

Grey Imported Products. Fobo Tyre Australia is the exclusive distributor for Fobo branded products within Australia. Fobo Tyre Australia disclaims any responsibility for, and will not provide warranty or product support for, products sourced outside of official distribution channels. Product compliance requirements vary by country. Products obtained through Fobo Tyre Australia or its authorized resellers are guaranteed to comply with Australian Standards, such as Australia's button cell battery laws. International models of Fobo products may not meet these standards. All products sold through Fobo Tyre Australia or its authorized resellers are certified and compliant with applicable local regulations.

Warranty. This Product is warranted to the original purchaser (“end-user”) for the period of one (1) years from the original purchase date (“Warranty Period”). This Product is warranted against defective materials and construction. This Warranty is void if the Product has been damaged by accident or unreasonable use, neglect, improper service or other causes not arising from defects in materials or construction. This Warranty is not transferable by the end-user. During the Warranty Period, if this Product hardware is found by Fobo Tyre Australia to be defective, Fobo Tyre Australia may, in accordance with the Australian Consumer Law: (i) to the extent deemed feasible by Fobo Tyre Australia, repair the defective portion of the Product hardware without charge to the end-user; (ii) replace the defective Product with a comparable new or refurbished product; or (iii) in the event that Fobo Tyre Australia is unable to repair or under (i) or (ii), refund to the end-user the net purchase price the end-user paid for the Product. If the Product is replaced during the Warranty Period, the replaced Product will be warranted for the full duration of the Warranty Period. If the Product is repaired the Warranty Period, except to the extent that Fobo Tyre Australia is expressly prohibited by applicable law, the warranty for the repaired Product will expire upon the expiration of the original Warranty Period or one (1) year whichever is longer. Other than the end-user’s cost to return the Product, no charge will be made for such repair and/or replacement. Fobo Tyre Australia strongly recommends that the end-user insure the Product for value if the end-user mails it. Any warranty service or support under this Warranty is conditioned upon the return of the Product to Fobo Tyre Australia.

Please allow up to three weeks for Fobo Tyre Australia to send the replacement. Fobo Tyre Australia does not promise that facilities for the repair of this Product or parts for the repair of this Product will be available.

Limitation of Liability. Subject to the provisions of the Australian Consumer Law and to the extent that Fobo Tyre Australia is expressly prohibited by applicable law, Fobo Tyre Australia hereby disclaims all other warranties, conditions, representations or guarantees of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Fobo Tyre Australia shall not be liable for loss of use of the product or other incidental or consequential costs, expenses or damages incurred by the end-user or any other user. To the extent Fobo Tyre Australia cannot lawfully disclaim any implied or statutory warranties or guarantees relating to the Product, the end-user’s statutory rights are not affected by this clause.
